An NRI is a person with Indian ancestry or citizenship who lives outside of India for work, to conduct business or pursue a profession there, or for any other reason that indicates he intends to stay outside of India for an undetermined amount of time.

When does NRI status expire?

Depending on how much time an NRI spends in India during the year of their return, they may lose their NRI status if they return permanently.

As a result, even if you return after October in a given fiscal year, you can still count as an NRI for that year because you will only be in India for a total of less than 182 days. In the same year, you would lose your NRI status if you returned before October.

Returning NRIs lose their NRI status and may become residents but not ordinarily residents (RNOR) or residents and ordinarily residents (ROR) of India.

Before returning NRIs become regular residents of India, they are granted the residential status known as RNOR (ROR).

NRIs returning to India are only eligible to become RNORs for any fiscal year if one of the following conditions is met:ย 

  • They have been NRIs for nine out of the ten years prior to the fiscal year under consideration;ย 

  • They have spent no more than 729 days in India during the previous seven years; orย 

  • They are not tax-residents(2) in any other country and their Indian income exceeded Rs 15 lakh in the prior year, during which time they spent between 120 and 181 days in India.

NRIs automatically become regular residents if they don't meet any of these requirements.
