What are the car parking rules of cooperative housing society in Mumbai?
As per the Maharashtra Ownership Flat Act (MOFA), residential societies can make rules for tenants and residents but they should comply with the guidelines of MOFA.
The RWA should have a list of vehicles that need to be parked. Resident owners should submit a copy of the RC book with the application form.
As per section 78 of the MOFA the housing society must allot parking spaces on the basis of first come, first serve if the space is unsold.
The residents must raise a formal request to the society secretary to apply for a stilt parking place.
Only a vehicle owner residing in a housing society may apply for a parking space.
No member shall be given more than one parking space. If required then the second slot can be allotted on the basis of availability.
As per Section 84 of the MOFA Act, every member with an allotted parking space must pay an annual charge to the parking society.
There should be a minimum of 5 percent free parking space for visitors/ guests according to the Brihanmumbai Municipal Corporation.

You must maintain a speed of 10km/hr after you enter the society premises.
Always make sure that your car or other vehicle has the entry sticker pasted on it. To get the entry sticker you have to submit a duplicate copy of your RC and also submit a filled application form. You may also need to follow other guidelines as prescribed by the particular housing society.
If you have visitors who want to park their vehicle within the society premises, then you will have to get permission from the MC and also need to inform the security guards regarding the same.
Ensure that you do not park your vehicle in front of the main gate, park, lift exit area or any such area that can block access for the people living in the society.

Unofficial Parking:
If you own a 4-wheeler vehicle, you’re eligible for a parking space (usually one or two slots based on your flat size).
Some members park more vehicles than allowed in their allotted space. For instance, a husband already using his spot might face issues when the wife buys a new car or a relative visits.
Solution: If you’ve been allotted a parking space, consult the Managing Committee (MC) before permanently parking additional vehicles. Unauthorized parking can lead to fines.
Guest Parking:
Even if there’s space inside the building for guest parking, security guards sometimes instruct visitors to park on the streets.
Solution: The building must reserve at least 25% space for visitor parking (as per BMC guidelines). Instruct guards to follow the apartment by-laws regarding visitor parking.
Unmarked Spaces:
Open parking spaces without proper markings can lead to confusion among members.
Solution: Society bye-laws require marking and numbering parking spaces separately for bicycles, 2-wheelers, and 4-wheelers.
Fair Allotment:
Ensure fair distribution of parking spots among residents.
Solution: The MC should transparently allocate spaces based on flat size and availability.
Tenant Parking:
Tenants should be aware of their parking rights as per the society rules.
Solution: Clarify tenant parking rules during the lease agreement.
Limited Number of Parking Spots:
Societies often have limited parking spots, leading to challenges.
Solution: Encourage carpooling and efficient utilization of available spaces.
