What are the car parking rules of cooperative housing society in Mumbai?

As per the Maharashtra Ownership Flat Act (MOFA), residential societies can make rules for tenants and residents but they should comply with the guidelines of MOFA.
  • The RWA should have a list of vehicles that need to be parked. Resident owners should submit a copy of the RC book with the application form.
  • As per section 78 of the MOFA the housing society must allot parking spaces on the basis of first come, first serve if the space is unsold.
  • The residents must raise a formal request to the society secretary to apply for a stilt parking place.
  • Only a vehicle owner residing in a housing society may apply for a parking space.
  • No member shall be given more than one parking space. If required then the second slot can be allotted on the basis of availability.
  • As per Section 84 of the MOFA Act, every member with an allotted parking space must pay an annual charge to the parking society. 
  • There should be a minimum of 5 percent free parking space for visitors/ guests according to the Brihanmumbai Municipal Corporation.
