Yes, the apartment provides parking space. The Real Estate Regulatory Authority (RERA) states that developers are not allowed to market covered or uncovered parking spots. It's because one of the fundamental services offered by the housing society is parking. So, it is unlawful for builders to also charge customers for parking.
What are some important housing society parking regulations?
According to the Maharashtra Ownership Flats Act (MOFA) parking laws, residential societies may create customised society parking rules for renters and residents, but only in line with the MOFA.
Residents and owners of cars must submit an application form together with a copy of the RC book in order for the RWA to have a list of the vehicles that will be parked.
The MOFA's Section 78 addresses the parking space allocation policy. It specifies that all unsold and available parking spots would be allocated by the committee based on the principle of first come, first served.
A formal request must be made to the society secretary by any homeowner interested in getting a stilt parking place.
A parking space can only be applied for by the car's registered owner.
It should be prohibited for any member to occupy a parking space with more than one vehicle. The availability of parking spaces will determine if any requests for a second slot can be made on an annual basis.
According to Section 84 of the MOFA, each member who has a parking space for a car is required to pay the society an annual fee, which is decided at the society's general body meeting.
As stated by the Brihanmumbai Municipal Corporation, a building should include at least 5% space for visitor parking. Security guards should be given explicit instructions on guest/visitor parking restrictions.
