Hello there, the answer to can a bank evict a tenant in a foreclosure depends on the new owner of the property, as per my knowledge. I’ll tell you about this in detail below.

Can Bank Evict Tenant in India?

The thing is that till the time the foreclosure process is going on, the tenant might not be asked to move out of the property. The case can vary from one to another. However, once the ownership of the property is transferred to the new owner, the decision to let the tenant continue in the property or not depends on the decision of the owner.

They may agree to take over the current lease agreement or issue a new one in its place. If the tenants agree to the new lease, they will be allowed to stay. But, in a case when the new owner doesn’t want to rent out the property, the tenant will be asked to move out by the bank.

The tenants are issued a notice in such a case, and they are given a timeline of 90 days to vacate the property.

This is all from my end. I hope you find this information helpful.
