BMC has shared guidelines for tenants and pagdi owners in case of redevelopment. The guidelines were brought in to safeguard rights of tenants and landlords. Below are the rights of tenants when pagdi building is being redeveloped:
  • The pagdi tenants living in non-cessed buildings before June 13, 1996 will be eligible for new flats whenever their building is redeveloped.
  • If the tenant has transferred pagdi property to another person after completing all the legal formalities then the new occupants will enjoy equal rights. They will be eligible to get accommodation after redevelopment.
  • DCPR further states that tenants will be eligible to get a minimum area of 300 sq ft and a maximum area of 1,292 sq ft, free of cost. If the property area exceeds the set limit then the tenant will have to pay the construction cost.
Pagdi system is an arrangement followed in Delhi, Mumbai and Kolkata from the pre-independence era. In this system, the landlord and tenants come to an arrangement and the tenant pays a pagdi amount and pays minimal rent. The tenant also enjoys rights over the property to a certain limit. Hi there,   Pagdi is a system where the tenant can sublet the property and the tenant can enjoy rights like an owner. In this system, a tenant can sell a land being the co-owner of the property but the landlord gets a 30-50% share after selling the property. But a tenant has to take consent from the landlord before selling the property. And you must know that a portion of the money that the tenant gets from subletting goes to the landlord. These are the tenancy rights in Pagdi system. It was reported that the Government is abolishing the Pagdi system and planning to reform the guidelines under RERA since this system is very confusing and misled a lot. So, what are the redevelopment agreement for tenants?   Questions like what happens to the tenants or the landlord can come to a person’s mind living in the Pagdi system. Well, luckily the Government is providing houses for people who are living in the Pagdi system. Let us learn about the redevelopment rules for tenants.  
  • The tenants will get a minimum of 300 sq ft and a maximum area of 1,292 sq ft free of cost. If the maximum area exceeds the tenant needs to pay for the construction cost.
  • The redevelopment can happen after getting consent from the landlord.
  • The redevelopment process can begin after 51 percent of the apartment owners give their consent.
