Can a Landlord Charge Interest on Late Rent?

We have a 2-storey house and both the floors of it are given on rent. The lady living on the first floor never fails to give her rent on time but the lady living on the second floor is the opposite. She pays her rent almost at the end of the month and sometimes we have to ask for it and then she pays. It has been almost a year and after many warnings, she hasn’t changed a bit. Last month what I did was, I asked for some interest charge from her. She asked me can a landlord charge interest on late rent without mentioning it in the agreement and I said yes. I might sound rude but I believe it was necessary.

Can a landlord charge interest on rent arrears?

In one word the answer is yes. If a tenant fails to pay the rent on time or within 14 days of the mentioned time, he/she can be charged for it. It was a recurring problem that I faced from my tenant so I was bound to take such action and this month she paid the rent on time. I hadn’t mentioned any such norm in the rent agreement but it is not mandatory as well. As a landlord, you can charge interest on rent due to late payment of rent and it is legal.

  When can I charge interest on late rent?

If a tenant is late by 2-3 days for paying the rent it is okay. But if a tenant is late for about two weeks or more, you can charge interest on rent. 

Also, remember that if the tenant disagrees to pay the rent, you can file a legal case against him/her and even get the person out of your house.
