Can a Landlord Cancel an Eviction?

Recently, I told my tenant that I would evict him as he’s not paying the rent for the last few months. I issued an eviction notice to him and was planning to go to court to file a case. My tenant came back to me and told me that he has been facing some financial issues but from now on there won't be any delays. I called my lawyer and asked can a landlord cancel an eviction.

How to Cancel an Eviction?

My lawyer told me that since I have not filed an eviction case in court, I will be able to cancel the eviction. He told me that, at this early stage, all I need to do is inform my tenant verbally or in writing that I am rescinding the eviction notice and he can remain in the property.

Following that, I asked him, can a landlord cancel an eviction after court order? My lawyer told me that once the eviction case gets filed with the court, the ability of the landlord to unilaterally cancel it becomes very limited. You will need to file a motion with the court requesting a voluntary dismissal before the hearing date.
