My uncle is a doctor and he had his agricultural land converted a few years back to use it for medical purposes. The process of transferring agricultural land to non-agricultural uses is known as land conversion. Other than when the property is converted into non-agricultural lands, agricultural lands cannot be used for development purposes such as residential, commercial, industrial, or medical facilities. Conversion of agricultural land into industrial land in Tamilnadu

According to what was previously said, the 2017 Tamil Nadu Change of Land Use (From Agricultural to Non-agriculture Purposes in Non-planning Areas) Rules regulate the process of changing land use in Tamil Nadu from agriculture to non-agriculture. Once the premium has been paid and the owner of the land has been verified as meeting all requirements, the conversion procedure will be finished, and the landholder will receive a conversion order.

The applicable fee for the conversion of agricultural land to commercial land in Tamilnadu

The local council will require the applicant to pay Rs. 1000 non-refundable scrutiny charges per plot.

The local authority must be paid a land use conversion tax for Tamil Nadu equal to 3% of the market value determined by the Indian Stamp Act of 1899. The concerned body will deposit the money in a government head of account and provide approval to carry out the development works.

Document Required for Conversion of agricultural land to industrial in Tamilnadu 

The following documents must be attached by the applicant in order to complete the conversion of Tamil Nadu land:

  • A self-attested copy of the applicant's power of attorney, leasing agreement, and sale deed

  • In the case of urban local bodies, the certificate of ownership should be obtained from the Executive Officer, Town Panchayat or Commissioner, Municipality Corporation.

  • Rural local authorities must receive a certificate of ownership in the owner's name from the Block Development Officer (BDO) of the Block Panchayat, Village Panchayat FMB, or Town Survey sketch Patta, Chitta, or Town Survey Land Records (TSLR).

  • Inappropriate site plan scales of 1:400, 800, and 1600

  • Layout for the proposed subdivision (in the event of a layout or subdivision proposal)

  • To envision all current construction surrounding the property within a 500-meter radius.

  • 13-year encumbrance certificate granted no earlier than 30 days after application submission

  • If the applicant wishes to establish a building plot within the region and the proposed site is located less than 30 metres from the railroad's property line, the railroad must first provide a No Objection Certificate (NOC).

How to convert agriculture to industrial land conversion in Tamilnadu?

Follow the steps below to convert agricultural land in Chennai to non-agricultural land:

Step 1: Complete the application form and send it to the local authorities with the assistance of the supporting documents stated above.

Step 2: Within seven days, the local council gives the Director an acknowledgement of the application.

Step 3: The Director evaluates the application and, in the case of wetlands, receives the Collector's prior approval. A report from the Joint Director of Agriculture is sought for drylands.

Step 4: The Collector will verify the information by visiting the property to see if it qualifies for the Change of Land Use section. The Collector makes sure that the proposed development won't have an impact on the drainage systems, distribution channels, or irrigation canals.

Step 5: The Deputy Director of Town and Country Planning will examine the specifics, including revenue records, nearby development, irrigation sources, and the current state of agriculture.

Step 6: For some drylands, verification is also carried out by the director of agriculture. The Director will determine whether the property has a drainage system or any nearby bodies of water.

Step 7: The local authority won't get the Director's approval until all the authorities are pleased with the verification.
