The procedure to evict a tenant I have shared below. But before that ensure that you have a valid reason for evicting the tenant. Valid reasons for eviction may include non-payment of rent, breach of terms of the rental agreement, illegal subletting, or the need for the landlord to use the property for personal use.

What are the Steps for Evicting a Tenant?

Check out the step by step eviction process:

  • Serve a legal notice to the tenant specifying the reason for eviction and providing a reasonable period for the tenant to vacate the premises. The notice period may vary depending on the reason for eviction and the terms of the rental agreement.

  • If possible, attempt to resolve the issue through mediation or negotiation with the tenant. Sometimes, disputes can be settled amicably without resorting to legal action.

  • If the tenant refuses to vacate the premises after the notice period expires, you may file an eviction suit in the appropriate court. The court having jurisdiction over the rented property will depend on its location.

  • Attend the court hearings related to the eviction suit. Both the landlord and the tenant will have the opportunity to present their case before the court.

  • If the court finds in favor of the landlord, it will issue an eviction order directing the tenant to vacate the premises within a specified period.

  • If the tenant still fails to vacate the premises after the court order, the landlord can request the court for the execution of the eviction order by seeking the assistance of the local authorities, such as the police or court-appointed bailiffs.

Once the eviction order is executed, the tenant is legally obligated to vacate the premises. The landlord can take possession of the property and change the locks if necessary.

In the recently introduced Model Tenancy Act, it has been mentioned that the landlord cannot evict a tenant during the continuance of the tenancy agreement. But there are certain circumstances based on which the eviction can take place. Here are the

reasons to evict a tenant:

  • Tenant doesn’t pay rent

  • Tenant doesn’t pay arrears of rent and other charges applicable

  • Tenant misuses the premises or carries out any structural change without the consent of the landlord

  • Landlord has to make changes or carry out repair of the property for which evicting the tenant is necessary

What are the steps to evict a tenant?

So, since my tenant was way past the tenancy agreement period, and wasn't paying rent or utility bills, I decided to finally evict her. This is how I did it:

  • I verbally notified her about my intentions

  • Following that I sent a legal notice to her to vacate just to be on the safer side

  • She didn’t take it seriously and refused to vacate, so I filed an eviction suit in civil court

  • Finally, the court heard my plea and sent the final eviction notice. I let go of the rent amount and asked her to pay the bills.
