Summary
Rental income is not permitted from a self-occupied property under Indian income tax rules, since such a property is meant solely for the owner's personal residence and carries a nil annual value. The moment rent is received, the rented portion loses self-occupied status and becomes let-out for tax purposes, requiring the income to be declared under Income from House Property. Deductions including municipal taxes and a 30% standard deduction under Section 24 are then available.

Yes, under Indian income tax rules, rental income is not allowed from a property that is officially treated as a self-occupied property. It is because a self-occupied house is a property used by the owner for their own residential purposes. However, based on whether you are sharing the space, renting out a section of it, or renting it out entirely, different tax regulations apply. I have shared more details about it below.

Is Rent Income Allowed from Self Occupied Property Under Indian Tax Rules?

You cannot lawfully declare your home as a let-out property to receive separate or tax-free rental income if you live there yourself. As long as the owner or their family resides in the property, its annual value is considered nil under the Income Tax Act, and no rental income can be shown from it.

  1. The moment the property, fully or partially, is rented out to a tenant and rent is received, the property loses its self-occupied status for that rented portion and becomes a let-out property for taxation purposes.

  2. In such cases, the rental income earned must be declared under the head “Income from House Property” while filing income tax returns.

  3. The taxpayer can then claim deductions such as municipal taxes paid and a standard deduction of 30% on the net annual value under Section 24 of the Income Tax Act.

  4. If only a part of the property is rented while the owner continues to stay in the remaining portion, the house can be treated as partly self-occupied and partly let out, and taxes are calculated proportionately.

Therefore, rental income itself is legally permitted only when the property is treated as let out under tax rules, not while it remains classified purely as self-occupied.

I hope this answers your query about is rental income allowed from self occupied property under tax rules.
