Summary
In India, a taxpayer can currently claim tax benefits on up to two self-occupied residential properties. Both houses are treated as having nil annual value, so no notional rental income is taxed if they are not rented out. Any additional property is considered deemed let-out and may attract tax on notional rent.

In India, an individual taxpayer is currently allowed to claim tax benefits on up to two self-occupied residential properties under the Income Tax Act. Before the financial year 2019-20, only one property could be treated as self-occupied for tax purposes. However, any additional house was deemed to be let out, even if no rent was actually earned from it.

How Many Self-Occupied Properties Get Tax Exemption?

Usually, it’s 2. The government amended the law to provide relief to homeowners who own multiple houses for personal or family use.

  1. As per the present tax rules, a taxpayer can declare two residential properties as self-occupied, and the annual value of both properties is treated as nil, meaning no notional rental income is charged to tax on these two houses. This benefit is available only if the properties are not actually rented out during the financial year.

  2. If a taxpayer owns more than two houses for personal use, the additional properties are treated as deemed let-out properties, and notional rental income may become taxable even if the properties remain vacant.

  3. Home loan tax benefits are also available on self-occupied properties. Under Section 24(b) of the Income Tax Act, a taxpayer can claim a deduction of up to Rs. 2 lakh annually on home loan interest for self-occupied houses, subject to prescribed conditions such as completion of construction within the specified timeline.

  4. Additionally, principal repayment may qualify for a deduction under Section 80C within the overall limit allowed under that section.

  5. If both self-occupied properties have housing loans, the combined interest deduction generally remains capped at Rs. 2 lakh in total for self-occupied houses.

Taxpayers should also understand that the self-occupied status applies only to residential properties used for personal residence and not for commercial use or rental purposes.
