The Torrens Title System is followed in Canada, the UK, and several East European countries. Torrens title is a land transfer and land registration system, in which a state helps create and maintain a register of land holdings. Now you know what is the torrens system. In India, the land is a state subject, so different states may have different mechanisms. In most cases, the name of the landowner is updated in the records of the local registrar's office. When this landowner sells the land, a deed is made referred to as a “registry’ in common parlance. This deed includes all the relevant info related to the property and its owner. This info keeps on passing from one deed to the next one on further sale. The deed is presented to the sub-registrar and when he verifies that the title is a good title, the deed is registered in the land revenue records.
One huge issue with this process is that there isn’t any “central” registry and each deed presents itself as a land ownership proof, increasing the possibility of forging the deeds and land fraud cases.
Advantages of the Torrens System of Land TitleIn the Torrens system, there’s a direct registration of title in a central registry. This process would involve the identification of every land parcel, entering these land parcels in a register, and mentioning the owner. However, the state becomes the keeper of all land and title records, and the title becomes a valid ownership certificate. This certificate will serve all the purposes if the owner decides to sell his land.
In India, some people are advocating for this system because it may bring transparency to the land records and land purchase-sale transactions. In this regard, the govt. had also made a “Land Titling Bill 2011” draft for creating a digital database for land records. This bill has been deferred for now.
According to this bill, a land title that the state guarantees offers proof of title to property ownership and offers and certifies the land boundaries based on actual ground surveys. After that, these titles are recorded on an ‘electronic register’, which the general public would be able to access online.
