What is Lis Pendens meaning in law?

Lis Pendens is defined as "a pending legal action," with Lis denoting "suit" and Pendens denoting "continuous or pending." The idea is based on the Latin maxim "Ut pendent nihil innovator”. It indicates that nothing should be modified during the course of a lawsuit. The doctrine's guiding concept is that the actual content of a lawsuit must not be shifted to a third party while it is pending. When you transfer such immovable property, you are bound by the outcome of the suit.

Requirement for the use of Lis Pendens:

The following are the conditions that must be met in order for the doctrine of Lis Pendens to be applied as stipulated in Section 52 of the Transfer of Property Act, 1882.

  • Suit or procedure is a frequent event.

  • A suit or procedure must be pending in a court of competent jurisdiction.

  • The suit involves a right to immovable property, either directly or indirectly.

  • There must be no co-operation in the lawsuit or proceeding.

  • Any party to the dispute should transfer or deal with the property in question.

  • The transfer must have an impact on the rights of the other claimant.

Where the Lis Pendens doesn’t apply?

Lis Pendens is not always appropriate. This Lis Pendens does not apply in the following situations:

  • The mortgagee sells the property in the exercise of authority granted under the mortgage deed.

  • In circumstances where the trustee is the only party impacted by the transfer.

  • In friendly suits and in collusive proceedings.

  • in suits involving pending transfers by a non-party to the suit

  • in situations where the property has not been correctly explained in the plea.

  • in situations where the relevance of the rights involved in the suit and those which are separated by transfer are different.

What is a notice of Lis Pendens?

The doctrine is based on need, therefore whether or not the transferee has any notice of a pending lawsuit is irrelevant. Even if he had no factual or practical knowledge of the ongoing suit, the transferee is bound by the court's decision. The suit's pendency begins when the court receives the plaintiff and ends when the court issues the final decree.
