The Transfer of Property Act, 1882 recognizes the concept of easements, which are rights enjoyed by the owner of a property over another property. There are four types of easement in Transfer of Property act recognised under the Indian Easements Act, 1882.
What are the Kinds of Easement in Transfer of Property Act?
- Continuous Easement
: Easements that are continuous in nature, such as the right to light and air.
- Discontinuous Easement
: Easements that are not continuous in nature, such as the right to draw water from a well.
- Apparent Easement
: Easements that are visible and can be easily identified, such as the right to use a pathway.
- Non-Apparent Easement
: Easements that are not visible and cannot be easily identifie
