Making sure that the claim's foundation is established is the primary criterion for completing a property caveat. The statement of claim, property or interest, and restriction are the three different types of grounds for a claim. It is necessary to address each of these three groups.

A caveat application must also include information like the names of the parties involved in filing it and the property's current registered owners.

  • Address and name of the individual with ownership or interest in the property

  • The interest allegedly asserted by the caveat-maker

Applying in writing to the Registrar of Titles is one way to remove a caveat. A supporting certificate from a lawyer must be included with this application.

A conveyancing attorney, who represents you, previously may sign this certificate on your behalf. A formal declaration from an attorney stating that the caveator has no ownership or title to the property must be included with the certificate. The caveat will expire and the Registrar would make the necessary changes to the register if the caveator does not always start a legal action to support their claim.

The burden of proving the legitimacy of the caveat during judicial proceedings rests with the caveator. The caveat claim will be deleted from the property title if the court finds it to be invalid.
