Deemed conveyance can be explained as the transfer of the interest, title, and right of the building or land in the housing society’s name. In the regular conveyance, the Promoters (developer, landowner, or construction builder) voluntarily or willingly offers the conveyance. The standard conveyance deed is required to be executed between the housing society and the promoters. However, sometimes the landowners or builders ain’t willing to execute the deed. In such cases, the Government of Maharashtra has given the right to the Competent Authority under the Maharashtra Ownership Flat Act (MOFA) to sign the conveyance deed on behalf of developers and landowners. This is known as a deemed conveyance act.

Deemed Conveyance Charges

A housing society should submit an application to obtain a ‘certificate of deemed conveyance’, by affixing a court fee of Rs 2000, along with all the required documents.

Deemed conveyance procedure

The society can file an application as per the prescribed format and submit it to the sub-registrar along with the necessary documents. After that, the competent authority will verify the documents and allow the builder/promoter to be heard within a reasonable time but not more than 6 months. If everything goes well, society will be issued the deemed conveyance.

List of Documents Required for Deemed Conveyance in Mumbai
  • Application Form 7 and a court fee stamp of Rs. 2,000 are to be submitted to the District Deputy Registrar, Co-operative Societies.

  • True copy and Affidavit of the Society Registration Certificate

  • Details about the Index-II as per the document issued by the Sub-Registrar of Assurance for all members.

  • List of members as per the specified format

  • Proof of paid Stamp duty and registered agreement copy of one individual apartment with Developer/Builder.

  • Development Agreement between Promoter and property owner

  • Copy of the Power of Attorney between landowner and builder

  • Copy of the legal notice issued to the original developer or owner to issue conveyance

  • Details like phone number and address of the Promoter or owne

Documents Obtained from City Survey Office:
  • Village form 6 and 7/12 extract of the land or Property Registration Card

  • City (CTS) Survey plan

Other Documents Obtained from the Concerned Municipal Authority:
  • Location plan of the building

  • Property taxes paid

  • Occupation Certificate (not compulsory)

How to Get Deemed Conveyance Online

Make sure your Society is enrolled on the MahaSahakar website and is Validated by Concerned Registrars (AR/DR). You can file an application for the same on the MahaSahakar Website.
