We can observe that when a business owner passes away, the company is frequently transferred over by a legal heir or a successor. Additionally, it is important to note that, the PAN of the assessor is the basis for GST registration and the GSTIN. As a result, since the individual taking over the business will be using a different PAN, a change in registration will be necessary. Therefore, the successor who has chosen to take over the sole proprietor's business will now need to register a new business using his or her PAN.
According to Section 22 of the CGST Act of 2017, a successor who inherits a business after a sole proprietor passes away is required to register under the GST Law as of the date of the transfer. Successors need to submit Form GST REG-01 digitally. The only thing that needs to be considered is that the cause to be chosen during the new registration will be the "death of the proprietor."
