For Buyer
When a property is jointly owned and it's time for each co-owner to hold a clearly defined share, a partition deed is what makes that division legal rather than just a family understanding. We draft it to reflect exactly how the property is being split, and register it so each share stands on its own.

Joint ownership is common in India, especially with ancestral houses and land that passed down through several heirs. It works until someone wants to sell, build, or simply stop sharing. A partition deed divides the property among the co-owners so that each person holds a separate, defined portion in their own name.
The deed describes the whole property, lists every co-owner and their share, and then allocates specific portions to each, with measurements, boundaries and access. Where the property cannot be physically split, such as a single flat, the deed may give it to one co-owner against compensation to the others. Everyone with a claim must be a party. If even one legal heir is left out, the partition can be reopened later, and that usually happens at the worst moment, such as when a buyer's lawyer finds the gap.
A partition can be done by agreement among the co-owners, which is simpler and quicker, or through a court when they cannot agree. We work with families who have reached an understanding and need it put down properly. Stamp duty and registration apply, and several states have lower or capped duty for family partitions. After registration, mutation of the individual shares in the revenue or municipal records is the next step, and we can follow that through too.
