For Owner
No bank will approve a home loan and no cautious buyer will close a deal without an Encumbrance Certificate proving the property carries no pending loans or legal claims. We procure yours from the registrar's records — either the manual route for older periods or the digital route for recent years.
Faster turnaround (2-3 days) for properties with digitised records.
For older or complex records that need a manual search.
An Encumbrance Certificate shows whether a property has any registered legal or financial liability against it for a given period. It lists the registered transactions on the property, such as sales, mortgages, gifts and partitions, as recorded at the Sub-Registrar's office. A nil EC means no registered transactions were found for that period, which is reassuring for the owner and the buyer.
Banks ask for an EC before sanctioning a home loan, and buyers' advocates ask for it before the sale deed. Lenders and lawyers usually want the last 13 to 30 years, depending on the state and the property. The certificate can be issued online for recent years in several states, and for older periods you may have to apply manually at the Sub-Registrar's office. Karnataka issues it through the Kaveri portal, and other states have their own registration department portals.
It is important to know what an EC does not show. It records only registered transactions, so an unregistered agreement, a pending court case, an unpaid property tax or an informal loan against the property will not appear in it. We procure the EC through the digital route where available and the manual route where it is not, check it against your documents and explain any entries. A nil certificate on its own is not a legal opinion on title, which is why many buyers pair it with a title opinion.
