The right of a grandson to the property of a grandfather depends upon the applicable inheritance law. In India, there isn’t any uniform Law of Inheritance. Inheritance and Succession are subject to several personal laws, depending upon religion. Let me explain how to transfer property from grandfather to grandson in case they both are Hindu:

Property can either be ancestral or self-acquired.

In Case of an Ancestral Property:

The right of a grandson to the ancestral property of a grandfather is by birth. It doesn’t depend upon the death of his grandfather or father. A grandson has a share of his grandfather's property since birth. Property is distributed in a way that each share gets divided into successive generations.

In Case of a Self-acquired Property

There are two ways to inherit a self-acquired property:

By rules of succession

By a will

If the deceased grandfather has left behind a Will, and that Will mentions that the grandson will have a certain share of their property, then that grandson will be entitled to inherit that share of grandfather’s property.

If no will has been left behind, then the Hindu Succession Act, 1956 will determine whether the grandson will have a right on the property of grandfather or not. The grandson can inherit their grandfather's property only if their parents have died before that grandfather.

The property owned by the grandfather can either be Ancestral or Self-acquired in nature. 

How to transfer grandfather property to grandson?

  1. Inherited:

    A property can be categorised to be an ancestral one if it has been inherited up to four generations of male lineage.

  2. Self-acquired:

    It is the one which has been purchased by own money.

Can grandfather gift property to grandson?

If the property is inherited, the grandfather cannot directly transfer the property to the grandson as each successive generation has rights to claim their share in ancestral/inherited property.

Whereas, if the property is self-acquired, the grandfather can directly transfer the property to the grandson either by a gift deed or by preparing a will.
