Is It Allowed to Transfer Khata Without Sale Deed Registration?

Generally, a khata transfer in Bangalore cannot be completed without a registered sale deed. The sale deed is the primary legal proof of property ownership recognised by BBMP and other Karnataka local authorities.

  1. A Khata is only a municipal tax record, but to update that record in the buyer’s name, BBMP requires documentary evidence showing that ownership has legally changed through registration at the Sub-Registrar’s Office.

  2. In normal property sale transactions, an unregistered sale agreement, a notarized document, a GPA, or a possession letter is usually insufficient for permanent Khata transfer. 

  3. According to BBMP procedures, a certified copy of the registered sale deed is one of the most mandatory documents for Khata mutation and e-Khata processing.

There are a few exceptions where Khata can be transferred without a sale deed registration. Those are:

  1. Inheritance after the owner’s death, transfer through a registered gift deed, partition deed, release deed, court decree, probate of will, or auction purchases under legal proceedings. In such situations, BBMP accepts alternative legal documents instead of a traditional sale deed.

  2. Many buyers in Bangalore mistakenly believe that possession of the property or payment through a sale agreement automatically grants ownership rights. Legally, this is risky because an unregistered transaction does not provide clear title protection under property law.

Even if a Khata is temporarily updated in some Gram Panchayat or revenue records, courts and banks still consider the registered title deed as the strongest ownership proof. You cannot transfer a Khata simply via verbal agreement or an unregistered document.
