Signing a deed is not the same as registering it. For most transfers of immovable property, registration at the Sub-Registrar's office is what gives the document legal force and puts it on the public record. The Registration Act, 1908 lists the documents that must be registered, and these include sale deeds, gift deeds and certain leases and mortgages.
The process involves paying stamp duty and the registration fee, booking an appointment on the state's portal, and appearing at the Sub-Registrar's office with the buyer, the seller and two witnesses, along with identity and address proofs, PAN and the deed, and sometimes photographs and biometrics. The registrar checks the paperwork, the parties confirm they are signing willingly, and the document is scanned and recorded. People often lose a day to a missing proof or a mismatch of names, and a document that should have been registered but was not may not be accepted as evidence of the transaction.
Our registration service picks up after the deed is drafted. We check the document, work out and pay the stamp duty and fees, book the slot, brief everyone on what to carry and see it through at the office. A document generally has to be presented for registration within four months of being signed, so timelines matter. Afterwards we collect the registered document and guide you on the next steps such as mutation, khata or patta transfer.
