Overview

Stamp duty is a state tax on property documents, and without proper stamping a document can be refused registration or treated as insufficiently stamped in court. E-stamping is the electronic method now used in many states, where the duty is paid online and a certificate with a unique number is generated, replacing the old stamp papers and franking.

In several states e-stamping runs through the Stock Holding Corporation of India (SHCIL), and other states have their own portals. The duty depends on the type of document, the value of the property or the consideration, the location and, in some states, the buyer's gender or relationship with the seller. Getting the amount wrong is common because the circle rate, the agreement value and the market value can all be different, and the higher figure is often the one that counts.

The certificate should be used within a limited period after it is issued, and the details printed on it, such as the parties and the property value, should match the deed.
