The court examines whether legally recognized grounds exist to invalidate the transaction and may consider documentary evidence, witness testimony, and the conduct of both parties before passing its judgment.
Until a court declares the deed invalid or cancellation is completed through a legally recognised process, the registered gift deed generally continues to remain effective.
