Where the donee does not consent or disputes the cancellation, the donor usually needs to file a civil suit before the competent court seeking cancellation of the registered gift deed.
The court examines whether legally recognized grounds exist to invalidate the transaction and may consider documentary evidence, witness testimony, and the conduct of both parties before passing its judgment.
Until a court declares the deed invalid or cancellation is completed through a legally recognised process, the registered gift deed generally continues to remain effective.
