  • You must draft a clear, legally valid document that defines the terms of renting between the landlord and tenant, ensuring both parties are protected from future disputes.

  • The process begins with writing the title “Rent Agreement” along with the date and place of execution, followed by complete details of both parties including names, addresses, and identification information.

  • Next, clearly describe the property being rented, including full address, type, floor, and any included amenities, so there is no ambiguity about what is being leased. The agreement must then specify key terms such as monthly rent amount, payment due date, mode of payment, and security deposit, along with conditions for refund.

  • It should also include the duration of tenancy (commonly 11 months in India for flexibility), lock-in period if any, renewal terms, and notice period required for termination.

  • Important clauses must cover maintenance responsibilities, utility charges, restrictions on subletting, use of premises (residential or commercial), and consequences of default or late payment.

  • After drafting, the agreement should be printed on appropriate non-judicial stamp paper as per state laws, since stamp duty is mandatory for legal validity.

  • Both landlord and tenant must sign the document in the presence of at least two witnesses, and if the agreement exceeds 11 months, it must be registered at the Sub-Registrar’s office to be legally enforceable.
