Q.

I made a rental agreement with a company on 5th Dec 2022 and a 15days breathing period is also given by them. The rent starts on 20th December but I have received only 30% of the agreed advance and have no idea about the rent. Kindly suggest how to proceed. Can we cancel our agreement right away without notice? If notice is given it will be a loss.

Dealing with rental agreements can be tricky, especially when things don't go as planned. Here's what you can do:
  1. Review the Agreement: Carefully go through your rental agreement. Pay special attention to the clauses regarding advance payment, rent commencement, and cancellation or termination procedures. Look for any specific terms related to the “breathing period” and what actions are allowed during this time.
  2. Communication: Reach out to the company and express your concerns. Inform them that you have received only 30% of the agreed advance and ask for clarification on the rent payment. Document all your communications (emails, messages, etc.) for reference.
  3. Legal Advice: Since you're considering canceling the agreement, it's essential to consult a lawyer who specializes in property law or rental agreements. They can provide you with legal guidance based on the specifics of your agreement and local laws.
  4. Notice Period: Generally, rental agreements include a notice period for termination. If you cancel the agreement without adhering to the notice period, it may lead to legal and financial consequences. However, if the company has breached the terms (e.g., by not paying the full advance), you may have grounds for immediate termination. This is where a lawyer's advice is crucial.
  5. Mediation: If you wish to avoid legal complications, consider negotiating with the company. Mediation can sometimes resolve disputes without the need for formal legal action.
Remember: Taking legal action can be time-consuming and costly. Weigh the pros and cons before proceeding. Now protect your property investments from legal issues. Buy NoBroker Legal Services plan to ensure all the legal checks
