How can I Transfer Property Ownership through a GPA Holder?

  • The first step is to verify that the GPA is genuine, legally valid, and grants the attorney explicit authority to sell or transfer the specific property. 

  • Carefully check whether the property details, owner's name, survey number, boundaries, and powers granted are clearly mentioned in the GPA document.

  • Confirm that the GPA has been executed according to the applicable legal requirements. Where required by law, ensure it has been properly registered and adequately stamped. 

  • If the GPA was executed outside India, verify whether it has been authenticated and adjudicated as required.

  • Verify that the GPA has not been revoked. The principal should still be alive and legally competent at the time of the property transfer because a GPA generally becomes ineffective upon the death of the principal unless otherwise provided by law.

  • Conduct complete title verification by examining previous Sale Deeds, title documents, Encumbrance Certificate, mutation records, revenue records, municipal records, approved building plans, tax receipts, and any pending litigation affecting the property.

  • Confirm the identity of both the principal and the GPA holder using valid identity documents. Ensure the attorney is acting strictly within the authority granted under the GPA.

  • Draft a Sale Deed mentioning that the GPA holder is executing the transaction on behalf of the owner under the authority of the General Power of Attorney. The GPA details should be accurately referenced in the deed.

  • Present the Sale Deed for registration before the jurisdictional Sub-Registrar. The GPA holder signs the document on behalf of the owner, while the buyer signs in their own capacity. Applicable stamp duty and registration charges must be paid.

  • After registration, apply for mutation of the property records with the local municipal or revenue authority so that the buyer's name is entered into the official ownership records.

  • Obtain updated property tax records, utility transfers, and other municipal records in the buyer's name after registration to complete the ownership transfer process.

  • Before making any payment, have an experienced property lawyer verify both the GPA and the property's legal status to ensure the transaction is legally valid and free from avoidable risks.
