A transaction between landlord and tenant is recorded in a rental agreement or a house lease agreement. To make a house lease or rental agreement in Chennai, a stamp duty of 1 percent is applicable on total rental value, the maximum limit being Rs. 20,000. If the rental period is below 11 months, a stamp paper of Rs. 20 to Rs. 100 will be enough.  You can purchase e-stamp paper from the designated vendors or you can get the rental agreement format from them and get it printed on an e-stamp paper. The following details must be mentioned in the agreement.
  • The total duration of the tenancy
  • Security deposit paid by the tenant
  • Penalty clauses
  • Decided rent
  • Tenant’s responsibilities towards property maintenance, etc.
In order to register the rental agreement, the following list of documents is required from both the parties, i.e., the Landlord and the tenant.
  • Property ownership proof, to be produced by the landlord
  • Government-approved identification card of both the parties
  • 2 passport size photographs of both the parties
The registration is done in the presence of the sub-registrar's in his office.

When you decide to move into a rental accommodation, your priority is to get the rental agreement in place. So how do you do that? Since you have asked how to make rental agreement in Chennai, I am going to explain the complete process to you. What is the procedure for rental agreement? Following is the procedure to make rental agreement in Chennai:
  • Discuss the clauses with your landlord/tenant and prepare a draft for your rental agreement.
  • Some of the clauses are mandatory to keep in the rental agreement. Make sure you add those clauses too.
  • Next, you will have to buy a stamp paper of the required value, which depends on the rent and security amount you have agreed upon.
  • Now print the draft of the rental agreement on the stamp paper.
  • Landlord and tenant, both will need to put their signatures on the agreement at the designated places.
  • Two witnesses will also need to sign the agreement.
  • Lastly, you will need to register the agreement at the local Sub-Registrar office.
Now if I talk about my experience, getting a rent agreement registered is not so easy. Getting the document ready is a herculean task and after that when you go to register this document, you have to wait for hours in sun or rain because in COVID period, to maintain social distance, you are not allowed to wait inside.  To avoid this situation, I would suggest you  Opt for NoBroker Rental Agreement Services.  All you have to do is fill in your details on the online agreement template and submit the draft.  They will print the agreement on a legal stamp paper. And within 3-4 days your rent agreement will be delivered to you. And if I talk about their charges, they are quite less in comparison to the charges taken by the agent or broker. The best thing is you can get this legally valid document at the convenience of my home.

Hey there, If you intend to rent a residential home in Chennai like me, you must be well aware of the rental agreement process. Any blunders in the rental agreement stamp paper can result in expensive tenant disputes. A rent agreement specifies the terms and conditions that the tenant/renter and the property owner have mutually agreed upon (landlord). The rules and procedures governing the rental agreement can differ depending on the location and state. As a result, depending on the city and state where the rental property is located, you need to be aware of the rent agreement requirements and also the rental agreement charges. Get your rent agreement drafted from scratch with the help of the legal experts of NoBroker. The process of making a rent agreement in Chennai and the documents required for it have already been clearly explained by Miss Soumya and Mr. Pankaj. So I would like to enlighten you on the types of rental agreements and the important clauses to include in your rental agreement.

Types Of Rental Agreements

  1. 11-Month Tenancy Agreement — Probably the most common rental agreement in the United States. This sort of contract lasts exactly 11 months and can be renewed at the conclusion of the period. Due to the short length of such agreements, registration is usually not required.
  2. Commercial Lease - Signed for business purposes between landlords and businesses or between two businesses, commercial leases follow no defined pattern. These papers can be tailored to both parties' needs and are frequently signed for longer periods of time. Because the penalty of not registering and notarizing such documents could be severe, they are rarely avoided.
  3. Long-Term Lease — Typically used for residential purposes, long-term leases require a hefty upfront payment rather than monthly rent payments. They are properly recorded and notarized because they involve a substantial sum of money.

Important Clauses To Include In Your Rental Agreement

Here are a few terms that should never be left out of a contract:
  • Rent, maintenance fees, and the security deposit must all be explicitly stated in the contract to prevent both parties from breaking their promises.
  • Pets - The presence of animals on the premises must be discussed and agreed upon ahead of time.
  • Late payment penalty - Landlords are permitted to impose a penalty for late rent payments. The implications of late payments must be indicated explicitly in the deed.
  • Cleaning and painting - If the Landlord cleans and paints the house before the Tenant moves in, the charges are deducted from the Tenant's rent. As a result, the deed must expressly declare that painting and cleaning costs will be deducted from the security deposit.
  • The minimal duration for which the deed cannot be terminated by both parties is referred to as the lock-in period.
  • Overstay penalties - If the Tenant continues to occupy the property after the contract has expired, the Landlord may impose a penalty. A punishment like this should be specified in the deed.
  • Eating habits - The landlord must state his restrictions regarding food habits that are permitted on his property.
