Summary
To correct mistakes in a registered rent agreement, both landlord and tenant must first agree on the errors. A Rectification Deed is then drafted, executed on the required stamp paper, and registered at the same Sub-Registrar office. Both parties must appear with ID proofs, sign the deed, and complete registration to make the corrections legally valid.

If the parties wish to change major terms such as rent amount, lease tenure, security deposit, or usage conditions, it is usually advisable to execute a supplementary agreement or a fresh lease agreement instead. Here is the process for correcting mistakes in a registered rent agreement:

  1. It begins with identifying the nature and extent of the error.

Mistakes in a registered rent agreement may include typographical errors, incorrect names of parties, wrong property descriptions, inaccurate rent amounts, incorrect lease periods, or other clerical mistakes that do not reflect the actual intention of the landlord and tenant.

Since a registered rent agreement is a legally binding document, any corrections should be made through a formal legal process rather than by simply altering the original document.

  1. In most cases, the preferred method is to draft a rectification deed. It is also known as a correction deed, which records the error and provides the correct details with the consent of all parties involved.

A rectification deed should clearly reference the original registered rent agreement, including its registration number, date of execution, and details of the parties. The document must specify the incorrect information appearing in the original agreement and state the correct information that should replace it.

  1. The next step is to purchase stamp paper.

Obtain nonjudicial stamp paper for the deed. Basic typographical or spelling errors typically incur minimal charges (e.g., stamp duty and registration fees of approximately Rs. 100 in India).

  1. Book a slot at the Sub-Registrar's office. Both the landlord and tenant must mutually agree to the correction and sign the rectification deed.

Depending on state-specific registration requirements and the significance of the correction, the deed may need to be registered before the relevant Sub-Registrar's office. Supporting documents, identity proofs, and a copy of the original rent agreement are generally required during the registration process. Once registered, the Rectification Deed is a permanent legal addition to the original contract.
