What Does a Possession Affidavit Mean?

  • A possession certificate itself is a government-issued document that establishes that the property has been handed over and is under the control of the holder, thereby validating their possessory rights.

  • This affidavit is typically drafted on non-judicial stamp paper and includes key details such as:

    • Name of the deponent (person making the affidavit)

    • Property description

    • Date of possession

    • Mode of acquisition (sale, inheritance, gift, etc.), and 

    • A declaration that no other party is in possession or dispute over the property.

  • It is signed before a notary or oath commissioner, giving it evidentiary value in legal proceedings. 

  • This affidavit is often used in situations where a possession certificate is not yet available, during mutation of property records, for applying for loans, or when resolving ownership or possession disputes in court.

Importantly, a possession affidavit alone does not confer ownership rights.
