Instead, the property is inherited by legal heirs based on religion-specific inheritance laws such as the Hindu Succession Act, Indian Succession Act, or Muslim personal laws.

What If a Property Owner Dies Without a Will?

For Hindus, including Buddhists, Jains, and Sikhs, the property is first distributed among Class I legal heirs under the Hindu Succession Act. These heirs generally include the spouse, sons, daughters, and mother of the deceased, all of whom receive equal shares in the property. After the 2005 amendment, daughters have equal inheritance rights as sons, including rights in ancestral property.

  1. If no Class I heirs exist, the property passes to Class II heirs such as siblings, grandchildren, or other relatives according to the legal hierarchy.

  4. To legally transfer ownership after death, heirs usually need documents such as the death certificate, legal heir certificate, succession certificate in certain cases, and property records.

  5. Mutation of property in municipal or revenue records is also necessary to update ownership details. If family disputes arise over inheritance shares, the matter may go to civil court for partition or settlement.

In some situations, nominees named in bank accounts or housing societies only act as trustees and do not become final legal owners unless succession laws support their claim.
