Recently, my friend asked me what is assessee. I informed her that an assessee is a person or entity who is legally obligated to pay taxes to the government under the Income Tax Act, 1961. Additionally, an assessee is any individual for whom the assessment is made. Under the act, any action has been made to determine his income.

Explain Assessee

An assessee can be an individual, a Hindu Undivided Family (HUF), a company, a firm, an association of persons (AOP), a body of individuals (BOI), a local authority, or any other artificial juridical person. The term broadly covers anyone whose income is subject to assessment by tax authorities, whether they owe tax, have refunds due, or even if their income is exempt.

  1. An assessee includes not only those who are currently liable to pay tax but also those who may be assessed in the future, such as a deceased person’s legal representative or a minor’s guardian.

  2. Additionally, the definition extends to persons from whom the tax department seeks to recover unpaid taxes, like a transferee of assets in certain cases.

  3. The key aspect is that the Income Tax Department has the authority to evaluate (assess) the individual’s or entity’s income, deductions, and tax liability.

There are different types of assesses, such as:

  1. Ordinary assesses (individual taxpayers)

  2. Representative assesses (those who file returns on behalf of others), and 

  3. Deemed assesses (persons treated as assesses under specific conditions).
