What are the New Rent Rules 2026 for Tenants and Landlords in India?
One of the biggest changes is that landlords cannot increase rent arbitrarily during an active tenancy, and rent revision must strictly follow the terms mentioned in the rental agreement.
In most updated tenancy frameworks, rent can generally be revised only once in 12 months, ensuring tenants are not subjected to frequent or sudden hikes.
Additionally, landlords are required to provide advance written notice before any rent increase, commonly a 90-day notice period, allowing tenants sufficient time to plan or negotiate.
Any rent escalation must be clearly stated in the agreement, and mid-term unilateral increases are generally considered invalid unless contractually agreed.
Another key reform is the introduction of structured limits on security deposits. Under the Model Tenancy Act framework, the security deposit is capped at a maximum of two months’ rent for residential properties and up to six months’ rent for non-residential properties, replacing older practices where landlords often demanded 6 to 10 months’ rent upfront in many cities.
These caps aim to reduce the financial burden on tenants at the time of renting and prevent exploitative deposit demands. The law also mandates that security deposits must be refunded at the end of tenancy after reasonable deductions for damage or unpaid dues, and landlords cannot withhold deposits without valid justification.
