The following documents are generally needed at the time of registration:

  1. Identity proof of both donor and donee, such as Aadhaar card, PAN card, passport, or driving license

  2. Address proof of both parties involved in the transfer

  3. Property ownership documents, including the sale deed or title deed

  4. Recent passport-size photographs of the donor and donee

  5. Latest property tax receipts along with an encumbrance certificate

  6. No Objection Certificate (NOC), applicable in case of agricultural land

  7. An affidavit confirming the deed's validity, as required under Section 22A of the Registration Act, 1908

  8. Two witnesses present with their valid identity proofs

  9. Property valuation certificate for stamp duty calculation

  10. Proof of stamp duty and registration fee payment

Why is a Gift Deed Important in Property Transfer?

A gift deed holds importance because it legalises the transfer process and provides documented proof in case of disputes or inheritance conflicts. Unlike a will, it takes effect immediately once registered, giving the donee absolute ownership without waiting for the donor's demise. It also offers tax exemption benefits up to a certain limit, and under Section 126 of the Transfer of Property Act, 1882, a donor retains the right to revoke it under specific conditions.
