According to the
redevelopment rules for pagdi system 2021-2022, you should go
to the Municipal Corporation or other concerned authorities for the verification and fitness-checkup of the building.
Earlier the consent of at least 70% occupants was required but now, the consent of just 51% tenants is required as per
pagdi system redevelopment rules
and here, all the tenants are ready so it is valid for the redevelopment.
But, the consent of the owner is more important so it becomes difficult for the initiation of the process of redevelopment. Therefore, if the Municipal Corporation after the verification provides with a document stating that the building is not fit it will be easier to convince the landlord or else further legal actions may be taken with the help of the jurisdiction. Whereas, if the building is declared fit, no further actions will be taken. The
redevelopment of pagdi building in Mumbai can pose a problem. I hope you have found your solution.

Hi,
I am aware that these situations come up with Pagdi tenants quite often. The landlords don’t tend to give approval for redevelopment of the building and risk the lives of tenants. But you should know that as a tenant in pagdi system redevelopment scenario, you are well within your rights to demand the redevelopment of a dilapidated building. Since your landlord is trying to be smart, you can do a couple of things.
You can collectively decide and find new buyers for the pagdi
system room in Dadar. You should know that even if it is a pagdi property, people are ready to buy it. This is one of the easiest ways. But you will have to give up your part of ownership and maybe find another property at a far off place.
Or you can choose to fight. Under Maharashtra Rent Control Act (which applies to even the pagdi tenants), you can file a suit against the landlord and seek approval from the municipal authorities of your area for the redevelopment of your property. The fact is that as a landlord, he is bound to cater to your need of having safe premises to live in. His refusal to do so will actually land him up in trouble. You can approach the municipal authorities to conduct a survey of the building and provide you with the permission to go ahead with redevelopment of pagdi building in Mumbai without landlords permission.
I hope this helps you out.

Hey,
As far as I know, you will have to take the permission of the building owner if you want to redevelop it. You should talk to him and share your concerns with him politely. Read more about the same here:
