Rights of mother in deceased son’s property are intact as per the Hindu Succession Act. Mother is among the Class I heirs of the property left behind by a deceased son.
If a son is survived by a wife, mother and children, then the property will be equally distributed among them. The father cannot be categorised as Class 1 Heir, he is Class 2 heir as per the Hindu Succession Act.
If after a few years the mother of the deceased son passes away too, then the property is rolled back to the son's wife and children and distributed among them equally.
