You must create the document outlining particular property rights in order to get a Special Power of Attorney (SPA) for selling real estate in Bengaluru. A SPA is a legally valid document where a property owner (the Principal) authorises someone else (the Agent or Attorney) to sell a specific property or execute a specific transaction on their behalf. It’s limited in scope, not broad control like a General POA.

How can I Get Special Power of Attorney to Sell Property in Bengaluru?

In Bangalore (and all of Karnataka), only a registered SPA (not just a notarised one) is accepted at the Sub-Registrar’s Office for property sale or deed execution. A simple notarised POA at home won’t let the agent sign a sale deed or register it. To get SPA for selling a property in Bangalore, follow these steps:

  1. Draft the SPA Document. Clearly state the full property details (address, survey/plot number, extent). 

  2. Mention exactly what powers are given, usually “to sign and register the sale deed and handle all connected formalities.” 

  3. Include names, addresses, Aadhaar/PAN details of the Principal and Agent.

  4. Print the draft on non-judicial stamp paper of the value required by the Karnataka Stamp Act. Both Principal and Agent sign it in the presence of two independent witnesses. 

  5. Go to the Sub-Registrar’s Office where the property is located. 

  6. Bring original SPA, identity & address proofs (Aadhaar, PAN) of Principal and Agent, and witnesses, plus property documents (title deed).

  7. Registration is mandatory for the property sale authority. Without it, the SPA is legally worthless for sale.

  8. Once registered, the Sub-Registrar will issue a registered SPA certificate, which lets the Agent sign the sale deed and handle the sale on your behalf.

If You Are Abroad (NRI), you can execute the SPA in front of an Indian embassy or consular officer (or a local notary & apostille if applicable). Then send the original to India.
