The basic steps to draft a rent agreement are;

  1. Negotiate and confirm the rent price, security deposit, lease term, notice duration, obligations, and other important terms with the property owner. Write these clearly to prevent future disagreements.

  2. Draft the document with all necessary information: names and addresses of both landlord and tenant, property address, rent amount, deposit, tenancy duration, payment plan, and conditions for termination. You may use a template or seek assistance from a lawyer.

  3. Calculate and pay stamp duty based on your state rules (varies by rent amount and tenure). E-stamp papers can be purchased online or at designated centres. Proper stamping makes the document legally valid.

  4. Print the document on the stamped paper. Each page is signed by both the landlord and the tenant. For legal validity, two witnesses are also required to sign their names and provide their addresses

  5. If the tenancy is 12 months or more, registration at the Sub-Registrar’s Office is mandatory under the Registration Act, 1908. Both parties and the witnesses must appear with ID proofs, photos, stamp duty receipt, and pay registration fees.

  6. Once registered, the office issues a registered rent agreement. Keep one copy each for the landlord and tenant for future reference or legal use.

  7. For contracts lasting up to 11 months, many states do not require registration, but you can notarize it or use state e-registration platforms to enhance legal enforceability

  8. Keep all copies, receipts, and ID proofs safe. Registered agreements hold stronger legal weight in disputes.
