How to do registration of rental agreement when owner is out of India?

When the owner is not in India, they have two options for registering a rental agreement: they can use an online registration system with biometric authentication or a Power of Attorney (POA). Once an Indian Consulate has attested the agreement, the POA holder may sign it on the owner's behalf. To know how to make rent agreement if owner is abroad, follow the below process.

• Ensure the rental agreement is drafted in accordance with local laws and encompasses all necessary details such as the names of the parties involved, property details, rental terms, and duration.

• The property owner may execute a Power of Attorney (PoA) in favor of a trusted individual present in India. 

• The PoA should be duly notarized in the country where the owner is currently residing. This step is crucial to validate the document when presented in India.

• Gather all necessary documents required for the registration of the rental agreement.

• The appointed agent, armed with the Power of Attorney and necessary documents, must visit the local Sub-Registrar's office. 

• Pay the applicable fees and register the rental agreement.

Through the Internet and the Government Portal, this verification is also possible from anywhere in the world. However, the Landlord and the Tenant(s) need both to have access to a biometric device and be familiar with how to install it on a laptop or desktop.
