As a builder, the most common I have encountered in Gurgaon is “how many floors are allowed in Gurgaon?”. In Gurgaon, 4 floors are allowed in a building. Previously, the Haryana government had only permitted floor builders to build 3 floors on each property. In addition, if a building had four floors, the floor couldn't be put up for sale because the builders couldn't register the fourth floor as an independent dwelling floor. However, after some modifications to the laws and regulations made by the DTCP, developers can now begin selling their fourth builder floor in Gurgaon.

What rules need to be followed to sell the fourth floor in Gurgaon?

Now you know that the number of floors allowed in Gurgaon is 4. But a builder must abide by the DTCP's new regulations in order to successfully sell their fourth floor. Among these guidelines are

  • The DTCP has published a rule stating that no buildings that are built into builder floors would have the plots fragmented in order to maintain equity for all owners. The land will not be unfairly divided among the owners; instead, each will own it equally.

  • It is a requirement for all Gurgaon builder floors that are available for sale that the building offers stilt parking for all of its residents and has enough parking space for the number of levels in the building.

  • DTCP has given adequate consideration to the distribution of land costs, ensuring that the cost is distributed equally among all owners according to the number of storeys in each building. For two floors, 50%, three floors, 33%, and four floors, 25%.

What structural improvements are required in the building as a result of the sale of the fourth builder floor being approved?

  • Adding a stilt parking space: In accordance with the regulations established by the determining authority, all four-story builder floors must have a stilt parking space to provide residents with enough space to park their cars in accordance with the size of the property.

  • Building lift service is a requirement: All structures with four stories must have a lift service available to the building's occupants. This is done to make sure that all building occupants, even the elderly, may quickly and conveniently reach the various floors as needed.

  • Building height restriction: All structures with three stories or more may not exceed 54 feet in height. A No Objection Certificate (NOC) from the local fire department and the structural stability and strength department is required to account for the height increase as a legal construction if a builder wishes to construct a housing unit that is taller than 54 feet.

However, I’d like to highlight that although in 2019, the Haryana government permitted the registration of a fourth floor as an independent floor. However, after a challenge to this policy in the Punjab and Haryana high court and a discussion in the state assembly, the government banned the construction and registration of fourth floors in February 2023.

According to the critics of the fourth builder floor in Gurugram, adding floors without upgrading the building's infrastructure strains the utilities and facilities already in place.

According to Chaitali Mandhotra, co-convenor of the United Gurugram Residents Welfare Association (RWA), an association of RWAs, before approving the construction of a fourth level, the government needs to improve the neighborhood's infrastructure.
