As per my knowledge, 5 people can stay in a rental property even if 4 of them are mentioned in the rental agreement. However, only the landlord is allowed to make such a decision. As a landlord, you should have an open discussion with your tenants first regarding this point.
I advise you to make a new rental agreement specifying the name of every tenant that’s living in the rental property to avoid legal issues in the future.
