Can a developer sell a piece of land declared as UD use in approved layout plan

Hi, In my understanding, a developer cannot sell undivided share of land or UDS land separately to someone else nor can he keep some land in his name. The land in the project area belongs to the owners of the flats.  Basically, UDS land is a portion of land which is set aside and allocated in your name on the plot on which your entire apartment complex has been constructed This portion of land is in proportion to the size of your flat to the overall area of flats combined. So it is upon the owner’s discretion if he/she wants to sell off their part of the undivided land, which essentially would mean selling of the flat as well.  Usually, it is this land that will appreciate in value over time, the cost of the flat is bound to depreciate owing to the wear and tear.
