While it is a great idea to write a will, most women don’t write a will despite having property in their names. In this answer, I will tell you who are legal heirs of deceased in India.

In case a woman dies without a will, the property will go in this order:

In Case of General Properties

(self-acquired or those received via settlement, will, gift, etc.)

1) Firstly to daughters and sons, including kids of any pre-deceased daughter and son, and the husband;

2) Next, to the husband’s heirs;

3) Then, to the father and mother;

4) Next, to the father’s heirs; and

5) Finally, to the mother’s heirs.

In the Case of Inherited Properties
  • If the property is inherited from her father-in-law or husband, it goes, in the absence of children, to the heirs of the husband.

  • If the property is inherited from her parents, it goes, in the absence of children, to the heirs of the father.
