If the deceased person has left a will, the distribution of property will be done according to the will. If there is no will, then the distribution of property will be done according to the Indian Succession Act, 1925.
If the property is owned jointly by two people with survivorship rights, then the surviving partner will inherit the property after the death of the other partner. If the property is owned by tenants in common, then the legal heirs of the deceased spouse will become co-owners and the property will be divided according to personal laws or the Hindu Succession Act.
