We all have read that the right to property is a Fundamental Right that got included in the Indian Constitution in 1950 but there was an amendment. Preparing for government exams helps you know several things and keep you updated. I recently came across a question- right to property removed by which amendment and I had no clue. I shared it with my friend and she answered that it is the 44th Amendment Act of 1978. I also came to know why the right has been removed so let me elaborate a bit on it.

Right to property was removed by which amendment and why?

Right to Property got included in the Indian Constitution in the 1950s under Article 31 and 19 (1)(f). But later it got removed by the 44th Constitutional Amendment Act in 1978. It posed several challenges and somehow hindered the goal of socialism and equalism. Since then it is a legal right but not a fundamental one. Article 300 A states that “no person shall be deprived of his property save by authority of law”.

  If there is a violation of the Right to Property, whom to approach now?

Previously people could approach the Supreme Court directly in case of any violation of the Right to Property but now they cannot do that. As per Article 226 of the Constitution of India, an individual has to appeal to the High Court first if he/she believes there has been a violation of the Right to Property.
