Where can We Register the Apartment Owners Association in Bangalore?
According to the Karnataka Apartment Ownership Act, 1972 (KAOA), you have to register a Declaration of the property with the Sub-Registrar's Office. This act is specifically for owners of apartments or flats. You must sign a Declaration, Deed of Apartment, and By-laws in accordance with KAOA.
To register under KAOA 1972, the developer or builder must:
Draft a Deed of Declaration (DoD), also known as Form A, in accordance with KAOA 1972.
At the Sub-Registrar's office, register the same. The builder must be extremely transparent and disclose all project specifics because this is a registered document.
In addition to the DoD, builders must complete the Deed of Apartment. It includes Form B (per KAOA 1972), in which the buyer/owner assigns their apartment to automatically becomes a member of the Owners Association after it is established and registered.
