Recently, one of my clients asked me what to do when landlord lies. I said that when a landlord in India misrepresents aspects of a tenancy, tenants have several options. The availability of these options depends on the nature of the falsehood and the existence of a written rental agreement. However, the first thing to do when a landlord lies is to keep a record of everything.
What to Do When Your Landlord Lies?
Here are a few tips you must follow.
Maintain thorough records of all interactions with the landlord, including dates, times, and content of conversations (emails, texts, letters). Evidence is critical.
Scrutinize the agreement for clauses relevant to the landlord's liability.
Consult a lawyer to draft and send a legal notice to the landlord.
If the lie pertains to rent increases, eviction procedures, or essential services, lodge a formal complaint with the Rent Control Authority in your state.
If the landlord's misrepresentation results in significant financial loss or hardship, consider filing a civil suit for breach of contract or misrepresentation. This requires substantial proof of the lie and its negative impact.
If your landlord's lie indicates unfair trade practice or a deficiency in promised services, a complaint can be filed with the consumer court.
In extreme situations involving fraud or criminal intent (e.g., forged documents), a police complaint might be necessary.
I hope you found this helpful.
