What is unlawful agreement ?
It is a state where an agreement is considered to be illegal. If an agreement is made by force or fraudulent reasons it becomes an unlawful agreement. This means the agreement has content that causes one party or all the parties involved to perform illegal actions i.e. violate the law.
If the court of law, be it District Court, High Court or the Supreme Court of India forbids the creation of an agreement, it is deemed as unlawful agreement(s). The consequence of these is void from the start itself. I hope you can understand my explanation till this point.
Unlawful agreements lead to a person getting injured or personal property being damaged. It is also immoral and against sections of public policies. To sum up, an agreement that is against the law of the land is called unlawful agreement. I also found out that IPC or Indian Penal Code prohibits the creation of such agreements.
