What Does Clear Title Mean in Real Estate?

The title deeds provide information about a property, such as the owner of the property, what rights or privileges the owner has, description and location of the property. The title deeds are usually registered and deposited with the Sub-Registrar Offices in India, where the property allotment/sale transaction occurs. I am planning to purchase a property for investment purposes. Yesterday, my father told me to make sure the property has a clear title before buying it. I did not know what clear title properties are, so I asked him about them.

He told me that a clear title is the synonym of a marketable title, absolute title, or good title. When an individual either singly or jointly with other individuals, enjoys ownership rights to a specific property, either immovable or movable, then such individuals are said to have title to the said property.

In the case of immovable property, the property itself or title to the particular property may be contingent, conditional, restrictive, leasehold, or not marketable. A clear title means a title that is free of any litigation, charge, lien, or encumbrance and is easily transferable/marketable. Any litigation, condition, restriction, or creation of charge takes away the owner’s right to transfer the particular property and such title doesn’t remain a clear title or transferable/marketable title.
