Recently, my lawyer friend informed me what is third party affidavit. This is a court-filed third-party affidavit asking for certified copies of case materials. What is a Third Party Affidavit?

  • For instance, if a person needs certified copies of a court file or FIR to support a Public Interest Litigation, they can file such an affidavit before the court, formally declaring their identity, purpose, and necessity of the documents.

  • Unlike affidavits from parties to the case, which serve as evidence, third-party affidavits are procedural.

  • They identify the deponent's name, address, and reason for access, and affirm the facts under oath before a notary or advocate. 

  • A typical format begins with the court heading, followed by clauses stating the deponent’s identity and the specific documents sought.
